This agreement represents the complete agreement and understanding between GrowingWeb.net and the access account customer and supersedes any other agreement, written or oral. Use of the GrowingWeb.net system constitutes acceptance of these Terms and Conditions. These terms and conditions are subject to change without notice, at GrowingWeb.net's sole discretion.

Use of this system (GrowingWeb.net) is at the sole risk of the user. Transmission or receipt of any material in violation of any laws or regulations is prohibited. Possession, distribution, or warehousing of unregistered commercial software or any other copyrighted material on any of GrowingWeb.net's machines will be cause for immediate account revocation.

The customer understands that he/she may find material on the network offensive, illegal or (in the case of executable files) potentially damaging to the user's computer, and agrees he/she will not hold GrowingWeb.net liable for any damages or distress incurred from receiving such materials. The user agrees to hold GrowingWeb.net harmless from any claims resulting from the use of this system.

GrowingWeb.net shall in no way be liable for lost profits, lost business opportunity, or any other direct, indirect, or consequential damages that you may suffer as a result of interruptions in service. Although GrowingWeb.net makes every effort to keep reasonably current backups of customer data stored in our system, GrowingWeb.net does not guarantee this backup and shall not be held responsible for loss of data.

The customer of record is responsible for all account activities, including those made by a third party. Your password is the key to account security; guard it carefully! As the account holder, you are responsible for all use or misuse, with or without your knowledge or consent, of your GrowingWeb.net account.

GrowingWeb.net may only be used for lawful purposes. The use of the Internet may not be used to solicit or conspire about illegal activities. The account holder agrees not to use the account for any illegal activities, including but not limited to:

• The storage, transmission, or distribution of child pornography;
• Forgery, including representing yourself as another person or network entity.
• The storage, transmission, or distribution of protected material, without the express written permission of the holder of such protection rights;
• Using the Internet to solicit or conspire about illegal activities.

In addition to the above guidelines, GrowingWeb.net services may not be used for any of the following:

• Storage, transmission, or distribution of adult material. Adult material is defined as any material that is sexually explicit or contains nudity of any kind. Determining what constitutes explicit material or nudity is at the sole discretion of GrowingWeb.net.
• Unsolicited and unwanted correspondence. Any email or other direct correspondence to any recipient where such correspondence is unsolicited, targeted to the recipient without their request, and so forth. This includes but is not limited to bulk email.
• Fraud or falsifying one's identity.
• Improper advertising
• Chain letters and pyramid schemes
• Misuse of other services
• Misuse of abuse reporting
• Inappropriate Usenet postings
• Storing, transmitting, or distributing harmful files
• IRC abuse
• Denial of service, including denial of service directly or indirectly caused by your action whether or not that action occurred as part of your account at GrowingWeb.net
• Reselling
• Unauthorized access. You may not attempt to access any systems or portions of systems to which you are not authorized, files you do not own, or programs that are not user programs, whether those items are at GrowingWeb.net or elsewhere on the net.
• Tampering with service. You may not attempt to interfere with any service provided by GrowingWeb.net or any other portion of the Internet.
• Sharing of accounts. Dialup accounts are intended for use by a single person or a single family. Accounts may not be shared with other users. An account may use no more than one dial-in access line at any time.

Customer Responsibilities
In addition to the conditions noted above, the customer is responsible for providing accurate application and billing information. Failure to provide correct information, including name, address, phone number and payment information may be grounds for GrowingWeb.net to terminate service. The customer shall notify GrowingWeb.net of any change in billing information, within 30 days of the change. Billing is designed to be sent via email and it is the customer's responsibility to check their email. Any account that is closed for non-payment or has an outstanding balance when closed will be turned over to a collection agency.

Any GrowingWeb.net dial-up account that is not a dedicated account is for interactive use only. FCG defines interactive use as an average of 12 hours a day or less. Any account that uses more than an average of 12 hours a day will be asked to upgrade to a dedicated connection. FCG reserves the right to terminate service for any customer who violates these terms and conditions.

Telephone Charges
GrowingWeb.net Internet Services assumes no responsibility for any phone charges incurred by our subscribers while accessing GrowingWeb.net Internet Services. Any disputes regarding phone charges are strictly between the customer and their local phone company or long distance provider.

GrowingWeb.net at its sole discretion may change the rates charged for any or all of its services. In the event of a change in pricing GrowingWeb.net will provide a minimum of 15 days notice to affected customers via email.

GrowingWeb.net can, at the request of the client, provide Microsoft FrontPage Extensions. FrontPage Extensions provide an end user with the ability to interface from a Microsoft FrontPage client to a FrontPage-enabled website, providing dynamic content management. However, due to the model FrontPage Extensions use, GrowingWeb.net cannot guarantee success when troubleshooting these products, and instead will provide technical support on a "best effort" basis. Even though GrowingWeb.net adheres to a full backup procedure, it is the responsibility of the client to maintain their own backups of their websites.

Use of the GrowingWeb.net system constitutes agreement to these terms and conditions, which are also published on our Web pages and are subject to change without notice. Repeat violations of these terms and conditions is grounds for account revocation. Any billing dispute with GrowingWeb.net will be handled by arbitration.
